The CFPB has decided to rescind amendments it adopted in 2022 and 2023 to its Rules of Practice for Adjudication Proceedings. These are the procedural rules that govern formal enforcement actions by the CFPB.
The amendments had transferred authority to decide dispositive motions from the hearing officer who is presiding over the proceeding, normally an administrative law judge, to the CFPB Director, which the CFPB now says concentrates too much authority in the Director at the expense of the hearing officer.
