NCBA Urges Court to Reevaluate Local Bankruptcy Rules

The NCBA has submitted a comment letter to the U.S. Bankruptcy Court for the Middle District of North Carolina. The letter focuses on local rules and a model plan developed for use in bankruptcy cases before the court. These appear to be in conflict with federal law in a few key respects, creating a disconnect between governing CFPB rules on disclosures and account access and the local rules of the court.

Given the potential for litigation or contempt proceedings for noncompliance, our comment letter requests that the court withdraw and reevaluate the provisions of the local rules that are at issue.
